Terms of Service

These Terms of Service ("Terms") govern your use of BackupYourSite — the SSH-based backup platform at app.backupyoursite.com, the backupyoursite.com website, and the optional BackupYourSite Cloud storage used by the BackupYourSite WordPress plugin (together, the "Service"). The Service is owned and operated by Yogya Infomedia Limited, trading as Nurotech — a unit of Yogya Infomedia Limited ("BackupYourSite", "we", "us", "our").

By creating an account, connecting a server, installing the plugin, or connecting the plugin to a BackupYourSite account, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

BackupYourSite provides automated offsite backup and restore for websites you own or are authorised to manage, in two forms:

  • SaaS platform (agentless): you grant SSH access to a server; we back it up on your schedule and store the result in our offsite storage, restorable from our console.
  • WordPress plugin: the plugin backs up your WordPress files and database from inside WordPress itself and, by default, stores the result on your own server at no charge — no account required. If you create a BackupYourSite account and connect it, the plugin can additionally push backups to BackupYourSite Cloud as a paid, optional offsite destination. Exactly what is sent to us when you do this is described in the plugin's readme.txt "External Services" section and in our Privacy Policy.

2. Accounts

  • You must provide accurate information when creating an account and keep your login credentials confidential; you are responsible for activity carried out from your account.
  • You must be authorised to back up, restore, or otherwise access any server or website you connect to the Service — for both the SaaS platform and the plugin's Cloud destination.
  • Notify us immediately at support@backupyoursite.com if you suspect unauthorised access to your account.

3. Acceptable use

You agree not to use the Service to:

  • Connect, back up, or attempt to restore a server or website you are not authorised to access;
  • Store or transmit unlawful content, malware, or material that infringes a third party's rights;
  • Attempt to bypass storage quotas, rate limits, or authentication;
  • Interfere with or disrupt the Service, its infrastructure, or other customers' use of it;
  • Use the Service to build a competing backup product from data or access obtained through it.

We may suspend or terminate an account that violates this section, with notice where reasonably possible.

4. Storage quotas and plans

Each plan carries a defined number of connectable sites and a storage allowance, shown on our pricing page and, for the plugin, on the Account screen after you connect. Exceeding your storage allowance may pause further offsite uploads until you free up space or upgrade; backups already stored are not deleted for being over quota alone.

5. Your responsibility for your own backups

Backups reduce risk; they do not eliminate it. You are responsible for:

  • Verifying that backups are actually running and completing (the Service surfaces backup status, history, and failure alerts for exactly this reason);
  • Testing restores before you need them for something that matters;
  • Understanding what a restore does before running it — for the plugin, a restore overwrites files and/or the live database, and files added since the backup are not removed;
  • Keeping your own copy of anything mission-critical; we are one layer of protection, not the only one you should rely on.

6. Payment and refunds

  • Paid plans are billed in advance on the cycle you select (monthly or annual). Prices are shown at checkout before you pay.
  • If a subscription payment fails or lapses, offsite/cloud backups pause after a grace period; data already stored is retained for a limited window so you can resume without loss (see the Privacy Policy retention section).
  • You may cancel at any time from your account; cancellation stops future billing at the end of the current billing period. Refunds for unused time are not provided by default except where required by law or expressly stated at the time of purchase.

7. Suspension and termination

We may suspend or terminate access to the Service for breach of these Terms, non-payment after the grace period, or a security or legal reason requiring prompt action. You may stop using the Service and delete your account at any time from the account screen or by emailing support. On termination, backup content is deleted per the retention terms in the Privacy Policy.

8. Intellectual property

The Service, including the BackupYourSite plugin's source code released under GPLv2-or-later via WordPress.org, the website, and our trademarks, remain our property or that of our licensors. The GPL licence governs your rights to the plugin's code specifically; it does not extend to the BackupYourSite Cloud service, our trademarks, or this website's content.

9. Warranty disclaimer

The Service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that backups will be error-free, that storage will be uninterrupted, or that a restore will always succeed on every possible hosting environment — see Section 5.

10. Limitation of liability

To the extent permitted by law, our total liability arising out of or relating to the Service is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold BackupYourSite harmless from claims, damages, and reasonable legal costs arising from your use of the Service in violation of these Terms, your lack of authorisation to connect a server or site, or your violation of a third party's rights.

12. Changes to these Terms

We may update these Terms as the Service changes. Material changes will be reflected by updating the "Last updated" date above; continued use after a change means you accept the updated Terms. For significant changes we will make reasonable efforts to notify active customers by email.

13. Governing law and dispute resolution

These Terms are governed by the laws of India. Courts at New Delhi, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. We encourage you to first raise any dispute with us at support@backupyoursite.com so we can try to resolve it directly before any formal proceeding.
